ECC Press Conference on Completion of Complaints and Objections Adjudication for the Preliminary Results

ECC organized a press conference and announced the completion of complaints adjudication process related to preliminary election. During the press conference, ECC commissioners informed about the number of complaints adjudicated by the PECCs. ECC leadership further informed that according to the article 91 (4) of the electoral Law, if the complainant or objector have objection over PECC’s decision, they can register their appeal at ECC within three working days after the announcement of the decision. ECC will adjudicate the appeals within 15 working days. ECC emphasized that it took decisions as per the law in transparent impartial manner. Completion of Complaints and Objections Adjudication Process for the Preliminary Results and Registration of Appeals
According to the article 91 (3) of electoral law, the legal timeline to address the electoral complaints related to the preliminary results of 2019 presidential elections to be addressed by the provincial electoral complaints commissions (PECCs) has ended yesterday (Monday). The PECCs have addressed all registered complaints and notified the decisions to the parties to the cases. Hence, the Independent Electoral Complaints Commission has completed the process of adjudicating the complaints in all 34 provinces.
So far, the PECC’s has made following decisions:
- Out of 16545 registered complaints, 9866 complaints were rejected by the PECCs due to the lack of proper evidences and documents
- 18 cases resulted to reprimand.
- 5316 polling stations in 21 provinces decided for the recount.
- 109 polling stations are invalidated.
- 75 people to be cash fined.
- 71 electoral employees are separated from duty.
- 3 complaints referred to AGO.
- 111 exceptional cases
As per the article 91 (4) of the electoral Law, If the complainant or objector have objection over PECC’s decision, they can register their appeal at ECC within three working days after the announcement of the decision. ECC will adjudicate the appeals within 15 working days.
It is also noteworthy that so far 769 appeals are registered in 17 provinces including Kapisa, Laghman, Panjshir, Bamyan, Ghazni, Paktia, Kunar, Nuristan, Badakhshan, Sarepul, Balkh, Ghor, Daikundi, Uruzgan, Zabul, Faryab and Nimruz.
